Subject: Cell Phone Policy
On January 1st, 2010 the new measures concerning cell phone use in vehicles will come into force and effect.
Although, it will be permissible to utilize hands free cell phones in a motor vehicle, even that use is restricted by requiring a voice activation in the dialling process.
Non-hands free cell phone use is prohibited in a motor vehicle.
The purpose of this communication is to inform you that our Company expects that any employee who wishes to make a non-hands free cell phone call while driving a Company vehicle, will be expected to pull over to the side of the road and ensure that all aspects of that communication are conducted from the stationary vehicle, including the mechanical aspects of dialling the call.
Should an employee fail to adhere to this procedure, then he or she can expect that disciplinary sanctions will follow up to and including termination.
We also advise that any monetary sanctions or damages arising out of a contravention the new law will be recovered from the employee involved, irrespective of whether the Company is held vicariously liable.
If any of our employees receive an incoming phone call on a non-hands free cell phone, then we expect that that call will be returned after the employee has had the opportunity to park the motor vehicle in a safe location.
Under no circumstances is an employee to engage in texting while having care and control of a motor vehicle.
